«មិនមែនកម្ពុជាមិនចង់ចរចាទ្វេភាគីទេ ប៉ុន្តែថៃបានរុញស្ថានការណ៍ដល់ចំណុច ដែលមិនអាចពឹងផ្អែកលើយន្តការទ្វេភាគីបានទៀត»។
ក្នុងកិច្ចប្រជុំលើកទី៣៦ នៃរដ្ឋភាគីនៃ អនុសញ្ញាអង្គការសហប្រជាជាតិស្តីពីច្បាប់សមុទ្រ (United Nations Convention on the Law of the Sea – UNCLOS) តំណាងអចិន្ត្រៃយ៍កម្ពុជាប្រចាំអង្គការសហប្រជាជាតិ (Permanent Representative to the United Nations) បានបញ្ជាក់យ៉ាងច្បាស់ថា ការសម្រេចរបស់កម្ពុជា ក្នុងការចាប់ផ្តើមនីតិវិធី «ការផ្សះផ្សារដោយបង្ខំ» (Compulsory Conciliation) មិនមែនជាជម្រើសនយោបាយទេ ប៉ុន្តែជាជម្រើសផ្នែកច្បាប់អន្តរជាតិ (International Legal Remedy) ដែលកើតឡើងបន្ទាប់ពីថៃបានលុបចោលជាឯកតោភាគីនូវ អនុស្សរណៈនៃការយោគយល់គ្នាឆ្នាំ២០០១ (Memorandum of Understanding 2001 – MoU 2001 / MOU44)។
អនុស្សរណៈឆ្នាំ២០០១ គឺជាក្របខណ្ឌគតិយុត្តិទ្វេភាគី (Bilateral Legal Framework) តែមួយគត់ ដែលប្រទេសទាំងពីរបានយល់ព្រមប្រើ ដើម្បីដោះស្រាយតំបន់ត្រួតស៊ីគ្នាលើព្រំដែនសមុទ្រ (Overlapping Maritime Claims)។ នៅពេលថៃសម្រេចលុបកិច្ចព្រមព្រៀងនេះជាឯកតោភាគី កម្ពុជាចាត់ទុកថា យន្តការទ្វេភាគីមូលដ្ឋានត្រូវបានបញ្ចប់ ហើយដូច្នេះ ការប្រើនីតិវិធី ការផ្សះផ្សារដោយបង្ខំ Compulsory Conciliation ក្រោម UNCLOS គឺជាផ្លូវច្បាប់ដែលនៅសេសសល់។
ឆ្លើយតបទៅនឹងការចោទប្រកាន់របស់តំណាងថៃថា កម្ពុជា «មិនចាប់យកការចរចាទ្វេភាគី ហើយធ្វើអន្តរជាតិវូបនីយកម្មនៃជម្លោះ» (Internationalisation of a Bilateral Dispute) តំណាងអចិន្ត្រៃយ៍រងរបស់កម្ពុជាបានបដិសេធយ៉ាងដាច់ខាតថា ការអះអាងនោះមិនឆ្លុះបញ្ចាំងការពិតឡើយ។
តាមការលើកឡើងរបស់ភាគីកម្ពុជា ថៃបានលើកហេតុផលជាច្រើន ដើម្បីបដិសេធការស្នើសុំប្រជុំចរចាទ្វេភាគីក្រោមក្របខណ្ឌ MoU 2001។ មិនត្រឹមតែប៉ុណ្ណោះ ថៃថែមទាំងលុបចោល MoU 2001 ជាឯកតោភាគី (Unilateral Termination) និងបន្តបង្កើនភាពតានតឹងតាមរយៈការប្រើកម្លាំងយោធា ដែលកម្ពុជាចាត់ទុកថា ជាការរំលោភលើអធិបតេយ្យភាព និងបូរណភាពទឹកដី (Sovereignty and Territorial Integrity)។
ដូច្នេះ ការដែលថៃអះអាងថា កម្ពុជាមិនចង់ចរចាទ្វេភាគី គឺផ្ទុយពីលំដាប់ហេតុការណ៍ជាក់ស្តែង។ ផ្ទុយទៅវិញ កម្ពុជាបញ្ជាក់ថា ដើមហេតុដែលនាំឱ្យមាននីតិវិធី ការផ្សះផ្សារដោយបង្ខំ "Compulsory Conciliation" គឺផ្តើមចេញពីការសម្រេចរបស់ថៃក្នុងការលុប MoU 2001 (MOU44) ជាឯកតោភាគី។ ប្រសិនបើយន្តការទ្វេភាគីដែលភាគីទាំងពីរធ្លាប់ព្រមព្រៀងគ្នានៅតែមាន កម្ពុជាមិនចាំបាច់ប្រើនីតិវិធីក្រោម UNCLOS នោះទេ។
សាររបស់កម្ពុជានៅអង្គការសហប្រជាជាតិ គឺច្បាស់លាស់ថា កម្ពុជានៅតែប្រកាន់ខ្ជាប់ការដោះស្រាយជម្លោះដោយសន្តិវិធី (Peaceful Settlement of Disputes) ស្របតាមច្បាប់អន្តរជាតិ (International Law) និងយន្តការដែលមានចែងក្នុង UNCLOS។ ការប្រើនីតិវិធី ការផ្សះផ្សារដោយបង្ខំ (Compulsory Conciliation) មិនមែនជាការបដិសេធការចរចាទេ ប៉ុន្តែជាលទ្ធផលនៃការដែលយន្តការចរចាទ្វេភាគី ត្រូវបានបញ្ចប់ដោយការសម្រេចចិត្តរបស់ថៃផ្ទាល់។

Cambodia Responds to Thailand at the United Nations
“It is not that Cambodia is unwilling to engage in bilateral negotiations; rather, Thailand has pushed the situation to a point where bilateral mechanisms can no longer be relied upon.”
Speaking at the 36th Meeting of States Parties to the United Nations Convention on the Law of the Sea (UNCLOS), Cambodia's Permanent Representative to the United Nations emphasized that Cambodia's decision to initiate Compulsory Conciliation was not a political choice, but an international legal remedy made necessary after Thailand unilaterally terminated the 2001 Memorandum of Understanding (MoU 2001 / MOU44).
The 2001 MoU constituted the only bilateral legal framework mutually agreed upon by Cambodia and Thailand for addressing their overlapping maritime claims. Following Thailand's unilateral termination of this agreement, Cambodia considers that the bilateral mechanism has effectively ceased to exist. Consequently, initiating Compulsory Conciliation under UNCLOS became the only remaining legal avenue available.
Responding to Thailand's allegation that Cambodia had abandoned bilateral negotiations and was internationalizing a bilateral dispute, Cambodia's Deputy Permanent Representative firmly rejected the accusation, stating that it does not reflect the facts.
According to Cambodia, Thailand repeatedly invoked numerous reasons to reject Cambodia's requests for bilateral meetings under the framework of the 2001 MoU. Moreover, Thailand unilaterally terminated the MoU (Unilateral Termination) and subsequently escalated tensions through the use of military force, which Cambodia considers to be a violation of its sovereignty and territorial integrity.
Therefore, Thailand's claim that Cambodia refused bilateral negotiations is inconsistent with the actual sequence of events. Cambodia maintains that the initiation of Compulsory Conciliation was triggered by Thailand's unilateral decision to terminate the 2001 MoU (MOU44). Had the mutually agreed bilateral mechanism remained in force, Cambodia would have had no need to invoke the procedures available under UNCLOS.
Cambodia's message to the United Nations is clear: Cambodia remains firmly committed to the peaceful settlement of disputes, in accordance with international law and the dispute-settlement mechanisms established under UNCLOS. The decision to initiate Compulsory Conciliation does not represent a rejection of dialogue or negotiations. Rather, it is the direct consequence of Thailand's unilateral termination of the only bilateral legal framework governing negotiations on the maritime boundary dispute.
